Frequently asked questions
- How long does trademark protection last in Türkiye?
- Under Industrial Property Law No. 6769 a registered trademark is protected for ten years from the application date and can be renewed for successive ten-year periods without limit. The renewal request must be filed within the six months before the protection period ends, and a mark not renewed in time lapses.
- Is an unregistered trademark protected?
- Unregistered use may attract limited protection under the unfair competition provisions of the Turkish Commercial Code. That protection depends on proof of prior use and does not reach the exclusive right that registration confers.
- What is the deadline to oppose a trademark application?
- Once an application is published in the Official Trademark Bulletin, third parties may file an opposition within two months, and decisions of the Office may be challenged by a request for re-examination within two months of notification. These are forfeiture periods, and once missed only court proceedings remain.
- What remedies are available against counterfeit goods?
- The right holder may bring a civil action for determination, cessation and prevention of the infringement together with pecuniary and non-pecuniary damages, and may seek a preliminary injunction where the conditions are met. Infringement also carries criminal sanctions prosecuted upon complaint, and an application for customs seizure can be made.
- How is software protected as intellectual property?
- Computer programs are protected as literary and scientific works under Law No. 5846 on Intellectual and Artistic Works, and protection arises from authorship of the code without registration. The product name and logo can be registered as trademarks, and economic rights should be expressly assigned in employee and contractor agreements.
